Billing authorization

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties. I hereby authorize this facility to charge my ACH draft or credit card account.

Once enrolled into group lesson(s) or private lesson(s), you will have the option to pay via check or cash by the 28th of each month for the following month or the credit card provided at the time of registration will be automatically processed on the 1st of each month. A card MUST be provided and kept on file. Monthly tuition is based on the number of classes available in a calendar month. Rates will vary depending upon how many days are offered in any given month. Lake Dragon Aquatics, PLC observed holidays will be prorated off monthly tuition.

If Lake Dragon Aquatics, PLC is unable to obtain authorization, a $10 fee will be assessed to your account on the 2nd of the month. Lake Dragon Aquatics, PLC does not make “reminder” phone calls regarding monthly payments.

Should you decide to withdraw from class, a written 30-day notice is required before you stop coming to class. To give a 30-day notice, you must email lakedragonaquatics@gmail.com. You will be assigned a drop date 30 days from the date of form submission. Do not fill out this form until you are ready to stop lessons in 30 days. Monthly tuition will be prorated for the next payment if form is submitted mid-month. I understand that I am responsible for payment whether or not my student attends classes until I notify this facility in writing.

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.

I have read and accept the general and financial policies as stated. I understand that by signing this authorization I am entering into an auto debit agreement with Lake Dragon Aquatics, PLC.

THESE POLICIES ARE SUBJECT TO CHANGE WITHOUT NOTICE.

Cancelling Your Group Lesson Program

If you would like to withdraw from a group class, you must give 30 days written notice prior to the start of the month or you will be responsible for the full payment for that month. If less than 30 days notice is given, we will offer you an in-house credit toward a future class for the remaining weeks of the month, minus a $15 cancellation fee. If you give us 30 days notice, no cancellation fee will be charged.

 

Cancelling Private / Semi-Private Lessons

You may cancel a private lesson without charge as long as we receive 24 hours written notice by email to lakedragonaquatics@gmail.com. If you provide less than 24 hours notice, you will be charged for that lesson. Since the month is prepaid, this cancelled lesson tuition will be offered as an in-house credit toward a lesson scheduled for a future month.

If you are unable to commit to a weekly time slot and prefer to schedule private lessons on an as needed basis, please place your request in writing to the email above. There may be a $5 administrative fee per lesson added to your tuition for this service.

 

Aquatic Therapy Sessions

Aquatic Therapy clients will be billed the private lesson rate. I apologize that I am unable to bill insurance at this time. As I grow, I will look further into that option. 

If you miss an aquatic therapy session, your account may be charged the private lesson cancellation fee if we do not receive 24 hours notice in writing to lakedragonaquatics@gmail.com. 

 

Cancellations by Lake Dragon Aquatics

If there is an unforeseen last minute pool closure (i.e. bodily fluid / fecal matter in the pool, thunder, or a pool maintenance emergency etc.) lessons may continue at the alternate pool location if available. 

If there is a last minute closing due to inclement weather or other emergency, you may be offered a makeup day or it may be considered a day off and your billing for the month will be adjusted. We will notify you by email as soon as possible. Sunday morning lessons will be determined by 8:00am and Weekday afternoon lessons will be determined by 9:00am.

 

Make-up Lessons

We offer 1 free make-up class per swimmer per session. This is based on availability and NOT guaranteed.  If we do not have an available class that matches your schedule, you may be forfeiting this day.  Refunds will not be given for classes that you have missed while we are in session. Makeups must be done during the time period/session that you are enrolled. Email lakedragonaquatics@gmail.com to request a make-up class.
 

 Payment Policies

You will receive an invoice for your swim lessons on the 20th each month for the following month. Invoices must be paid by the 30th, or your spot may be forfeited.

Payments in cash must be hand delivered to Nykia Hunter in an envelope with your name on it. We will email you a receipt once the payment is posted to your account. Payments made by check may also be delivered in person or sent by mail. Please email for mailing address. There will be a $20.00 fee charged for any checks returned by the bank.

One-time payments may be made by credit card for special classes, clinics or merchandise through the Client Portal.

 

Prorating

Each month will be prorated for the number of weeks that we are in session. Please refer to the calendar on our website for scheduled days off. For example, if there is a holiday on your scheduled day, you will not be charged for that lesson. If you enroll mid-month, you will only be charged for the lessons remaining for that month and prepay the following month.

 If you have changed your mind about enrolling in a particular class, please let is know by email as soon as possible. Request to cancel less than 24 hours before the session begins will result in a $15 cancellation fee. There will be a $20.00 fee charged for any checks returned by the bank.

 

Refunds

There will be no monetary refunds given after a class session has started. Credits toward future classes are given for such circumstances as a medical emergency (a doctor’s note may be requested), family emergency or at the discretion of the owner. Credits will be prorated from the time of the resolution of the request. There will be a $15 surcharge for refunds requested less than 24 hours before a class starts.

 

Medical Emergencies

The undersigned gives permission to Lake Dragon Aquatics, PLC, its instructors/assistants, Days Inn, Baymont Inn and Suites, and its owners and operators to seek medical treatment for the participant in the event they are not able to reach a parent or guardian.

Puddle Jumper Policy

In an effort to be inclusive to families with multiple children and only one available caregiver, it is the policy of Lake Dragon Aquatics, PLC to allow up to two children ages 3-6 in the pool during a Baby Dragon class wearing provided puddle jumpers. The children must either stay near the stairs or actively participate in the class without being disruptive to the students in the class. In addition, these children must be enrolled in a Lake Dragon Aquatics, PLC swim lesson of their own.

If your child is able to remain safely seated and occupied on the pool deck during the baby class, then they do not need to be in the pool, however, you may choose to have them wear a puddle jumper on deck as a precaution.

This policy is meant as a safety precaution and an exception to the policy in which family members cannot be in the pool during classes they are not enrolled in.

 Release of Liability

In consideration of being allowed to participate in any way in the Lake Dragon Aquatics, PLC programs, and/or in its related events and activities, I, the undersigned, acknowledge, appreciate and agree that:

 1. The risk of injury from activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and


2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and


3. I willingly agree to comply with the stated and customary terms and conditions for participation. If however, I observe any unusual significant hazard during my presence or participation, I will remove myself or my child from participation and bring such to the attention of the owner of Lake Dragon Aquatics, PLC immediately; and


4. I, for myself and on the behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS Lake Dragon Aquatics, PLC, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

 I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING OR E-SIGNING IT, AND SIGN OR E-SIGN IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.

IF, FOR ANY REASON, A PROVISION OF THIS AGREEMENT IS DECLARED NULL AND VOID BY A COURT OF COMPETENT JURISDICTION OR BY ANY OTHER OPERATION OF LAW, I UNDERSTAND AND AGREE THAT THAT NULL AND VOID PROVISION BE SEVERED FROM THIS AGREEMENT AND ALL THE OTHER PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.

 FOR PARENTS/GUARDIANS OR PARTICIPANTS OF MINORITY AGE
(UNDER AGE 18 AT THE TIME OF REGISTRATION)

 This is to certify that I, as parent/guardian with legal responsibility for this/these participant(s), do consent to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.

 

Waiver

Assumption of Risk

I understand, agree, and acknowledge that there are risks inherent in the sports activities conducted by Lake Dragon Aquatics, PLC, including but not limited to paralyzing injuries, brain injuries, and death. These activities may be of a hazardous nature and/or may include activities such as swimming, diving, a variety of strenuous exercise and physical activities. With the full understanding of the facts, I state that to the best of my knowledge, the student(s) listed have no medical, physical, or emotional health conditions which would hinder or prevent his/her participation in Lake Dragon Aquatics, PLC programs.

Authorization of Likeness Rights

At any given time Lake Dragon Aquatics, PLC, its instructors, and assistants, may take photographs or video recordings of classes both at and away from the home pool. I authorize Lake Dragon Aquatics, PLC, its instructors/assistants, or its designated agents to use and display likeness images of my child or myself for advertising, website and/or decorative purposes.

We will do all we can to respect your privacy and not use your or your child’s image for public purposes when we are notified in advance in writing. This authorization shall be effective until revoked, in writing, and received in-hand by Lake Dragon Aquatics, PLC.

Pool Policies

The pools we utilize have the following policies in order to ensure a safe and clean pool environment:

  • Please do not bring food onto the pool deck. You may eat in designated areas only
  • A responsible adult must remain on the premises for the entirety of the lesson
  • Please come to lessons no earlier than 15 minutes before your scheduled lesson time. Swimmers may not enter the pool until their lesson has begun.
  • If a participating child is not completely toilet trained, please be sure that they are wearing two non-disposable swim diapers.
  • If your child has a fever, diarrhea, or any type of contagious condition (respiratory, eye, or skin rash, etc.), please do not bring them to class until your doctor has cleared them to continue with this activity.
  • If a participant has a bowel movement or vomits in the pool, the pool will need to closed for sanitation and a $100 cleanup fee may be charged.
  • Once the participant’s activity is finished, please promptly leave the pool area. Siblings and family members are not permitted to swim.
  • At the Days Inn location, there are two bathrooms, which can be used for changing. In order to decrease congestion, please come in your swimsuit if possible. Do not change your children on the pool deck.
